Horse euthanized, 6 others treated in abuse case in Scottsdale area

One horse was euthanized and six others were taken to veterinary clinics for treatment after Maricopa County Sheriff's Office deputies found them to be severely underweight in a Scottsdale-area boarding stable Thursday night.
MCSO deputies believe Michelle Salazar is the owner of the horses and 20 others that are being kept at the stable.
Deputies have been unable to locate Salazar, who likely faces animal cruelty charges, said Officer Chris Hegstrom, a spokesman for the Maricopa County Sheriff's Office.
The six horses taken for treatment are estimated to be between 300 and 450 pounds underweight. They will be kept in a rehabilitation program for two to three months, said Alana Hendricks, an Arizona veterinarian.
The 20 other horses owned by Salazar appeared to be thin, but not to the extent of the seven others, Hegstrom said.
The horses were scored on a scale of 1 to 9 by a veterinarian, with one being the worst condition. Seven of the horses scored a two or worse, indicating they needed immediate treatment, according to a news release from the Maricopa County Sheriff's Office.
More than 40 horses were kept at the boarding stable near 144th Street and Dixileta Drive in the north Scottsdale area. Not all of them belonged to Salazar. Salazar doesn't own the stable, she just rents space there.
MCSO deputies have been investigating this case since 2011.

THE BUREAU OF LAND MISMANAGEMENT DOES IT AGAIN, AND THEY ARE ROUNDING UP THE USUAL SUSPECTS — THE WILD HORSES, OF COURSE — AND CHASING THEM WITH HELICOPTERS IN THE HEIGHT OF FOALING SEASON.   How did it come to this?
          
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 Below are the fragile, soft feet of a one-day-old mustang foal born in captivity.  Look how thin the hoof wall is, barely twice the thickness of my thumbnail. 
                  BELOW:  And the sole of this foot (the inner, flat part of the hoof), which is almost rock-hard in adult horses to withstand covering all kinds of terrain, in this youngster's foot is rubbery and pliable, similar to a large pencil eraser, and it gets worn down in the rough terrain in a like manner.  
        BELOW:  The same one-day-old foal's soft hind feet, with their paper-like hoof walls and rubbery soft sole.  His Maker equipped him well, but not to withstand running from a helicopter over miles of rocky ground in the first six weeks of his life.  
         HOW DID IT COME TO THIS, where BLM is violating its own protocols to remove many horses before their scheduled roundup several weeks away, risking the lives of the very young?   — who, by the way, are not being seen in the trap, I'm told.  So where are they?  
         BLM FOR THE LAST FOUR YEARS has not reduced livestock grazing in this Jackson Mountain HMA as good range stewardship called for.  Thus, they have denuded the range; and let's please not forget that horses are outnumbered by cows and sheep in this area, which  is one of the few remaining legal areas designated for the wild horses and burros.  
         Additionally, there are serious drought conditions BLM has been monitoring in this area, and BLM began hauling water weeks ago.
         But once again, it's the wild horses and burros, who are by law supposed to be considered an integral ("essential, central, core") part of the natural system of the public lands, are instead being driven off their homes in this illegal way because of BLM's own mismanagement.  And BLM boasts that the livestock permittees have voluntarily reduced their grazing.  That's great for the permittees, but it is BLM's responsibility to manage the grazing, not rely on the permittees' goodwill, which we, by the way, very much appreciate.

Witnesses describe horse slaughter farm (Florida)

Our series of recent reports on allegations of ongoing horse slaughter and illegal horse meat sales has shocked many of our viewers.

We've been contacted by many of you since we broke the story just over two weeks ago, including two men who came forward to tell us they knew there was a problem before Richard Couto of Animal Recovery Mission (ARM) went undercover in Hillsborough County and started shooting video.

We're not identifying the men, because they fear for their safety.

"It's like a mafia, and they will kill you," one said.

They say that when they saw some of the video in our initial story on June 12th , they knew exactly where it was because they'd been there.

One of the most graphic and gruesome videos shows what appears to be a pit full of skeletons and horse parts, including a clearly visible horse head. It's such a shocking image, Couto put it on the cover of his 40-page report.

The men we interviewed say they saw the same scene, only that it's even worse than depicted in Couto's video.

"It looked like a dumping ground for dead horses. It was awful."

They also say what appears to be a pit, is actually an alley.

"This only shows like 100th of what's there. This alleyway right here? It's gotta be 85 or 90 feet long. The farther toward the middle you get, the higher the bones, they were five feet deep."

They also say they saw the hog pen in Couto's video, the one scattered with bones and horse skulls.

"Dead cows, horse carcasses, feet, goats, pigs and the hogs were in there eating it...millions and millions of maggots. The worst stench of death that you've ever smelt. It was bad."

And one of the men says he was offered what became illegal two years in the state of Florida.

"He offered to get me an Appaloosa and butcher it for me."

"For you to eat?" we asked.

"Yes. For me to eat," he replied. "Somebody needs to be called. Somebody needs to come in and this needs to stop."

In a year-long investigation that began last June, Couto says he posed as a customer and went to six farms in the Citrus Park area of Hillsborough County. He says he made four horse meat buys, two of them accompanied by a USDA investigator.

"I've bought horse meat for $4 a pound. Why cheaper here than in Miami? So many people are killing horses in Hillsborough County, and this is straight from the horse killers' mouths themselves that I have on tape," Couto said.

Victor Crist was the state senator who helped bring about the ban on selling horse meat in 2010.

Shocked and disturbed by what he saw in Couto's video, Crist, who is now Hillsborough County Commissioner, took his concerns to the full board. On Wednesday, the commissioners voted unanimously to ask local legislators to take up the 2010 ban and address any loopholes it may have.

The Hillsborough County Sheriff's Office says while the 2010 law makes it illegal to sell horse meat, it doesn't ban slaughtering a horse for your own personal consumption. The board also voted to ask the county attorney to see what can be done at the local level to address the issue of the slaughter of all animals and where it takes place.

"What I'm asking for here is that we take a look at what we can do under existing state and federal law, and how do we tie it in to our ordinances so that we can be clear where and when and how you may and can not do this," Crist said.

FOX 13 learned today that after a meeting between ARM and the Hillsborough County Sheriffs Office, which a spokesman described as "positive," they'll work together as they continue their investigation.

Horse auctioneer facing cruelty charges

LOS LUNAS, N.M. (KRQE) - The owner of a Los Lunas livestock auction is facing charges that he didn't properly treat four horses in his care.
On Tuesday 13th Judicial District Attorney Lemuel Martinez's office filed 12 misdemeanor charges against Dennis Chavez, owner of Southwest Livestock Auction.
The case stems from undercover video taken by animal rights group Animals' Angels on March 10. The video appears to show four emaciated, sickly horses at the auction struggling to stand or lying in the dirt.
According to a report filed by the group, three of the horses were put down by an auction employee. The fourth one died.
Four of the charges Chavez is facing are for animal cruelty, four are for failing to treat an animal that can't walk and four more are for not having a bill of sale for the horses.
Martinez says even if the horses were sickly when Chavez's auction received them, anyone who receives a horse has a responsibility to properly care for it or put it down humanely.
"We feel that something should've been done immediately or shortly thereafter upon receipt of the animals if they couldn't walk or move very well," Martinez said. "There's an obligation we feel, incumbent on people who receive animals in that shape."
If convicted, those charges could add up to nearly 12 years in prison.
When News 13 reached Chavez by phone Tuesday afternoon, he said he was not aware charges had been filed and had no comment otherwise.
Chavez was charged with 16 counts stemming from another animal cruelty case in 1990; all but one were dismissed by prosecutors. He was acquitted on the remaining charge.

Neglected horses rescued north of Scottsdale

SCOTTSDALE, Ariz. - The Maricopa County Sheriff's Office is investigating a possible case of animal abuse just north of Scottsdale in Rio Verde.
Deputies were called out there on reports of malnourished horses.
One of the horses is in such bad shape, it may have to be put down.
The owners of the horses are being questioned and may be arrested.

Colorado Wildfires – What does it mean for our wild horses?

A lot of folks have been asking us about all the wildfires that are happening in the state of Colorado. There are a lot of them occurring.
One question on a lot of peoples’ minds: what does this mean for the wild horses?
Right now, none of the fires burning in the state are threatening any of the wild horse herds in Colorado.

The fires nonetheless are very serious, many people have lost their homes and thousands more have been evacuated across the state. The Waldo Canyon Fire is the one threatening a lot of the western side of Colorado Springs. As you may know, the Cloud Foundation office is located in Colorado Springs, but we are not close to the fire. Many thanks to those of you have called with your concerns.

Corporate interests converge in Wyoming to rid the state of half its remaining wild horse population

(Cheyenne, Wyoming – June 27, 2012)… Today, in the U.S. District Court of Wyoming, the leading public interest law firm Meyer, Glitzenstein & Crystal filed papers to protect Wyoming’s wild horse population from a legal attack by the nation’s largest livestock grazing association and the multi-billion dollar, oil and gas giant, Anadarko Petroleum Corporation.
Filed on behalf of the American Wild Horse Preservation Campaign (AWHPC), The Cloud Foundation, and the International Society for the Protection of Mustangs and Burros (ISPMB), the papers responded to briefs filed by the Rock Springs Grazing Association and Anadarko in a lawsuit that seeks to force the Interior Department to remove all wild horses from the “Wyoming checkerboard,” a two-million acre swath of public and private land in southern Wyoming. The area includes four wild horse Herd Management Areas – Salt Wells Creek, Great Divide Basin, White Mountain and Little Colorado – administered by the Interior Department’s Bureau of Land Management (BLM).
In November, the federal court granted the wild horse advocacy groups intervenor status in the case (Rock Springs Grazing Association vs. Interior Secretary Ken Salazar.)
These opening briefs represent round one in the legal showdown between wild horse advocates and big corporate interests over the use of public lands in Wyoming and the future of wild horses there.
“At the same time RSGA is complaining about a hundred extra wild horses on two million acres of land – half of which are publicly owned – the grazing association is permitted to have the year-round equivalent of tens of thousands of private livestock grazing on these same lands for its own economic benefit at taxpayer expense,” wrote attorney Katherine Meyer in her response brief filed today. “Thus, while RSGA complains mightily about the fact that the wild horses are using forage on private lands, it conspicuously fails to inform the Court that private livestock is using the vast majority of the forage on public lands that could otherwise be used by wild horses that, unlike livestock, are required by statute to be protected.”
“Despite tremendous public opposition, the BLM has removed thousands of horses from the Wyoming checkerboard in the past two years, but this is not enough to satisfy the livestock industry,” said Suzanne Roy, AWHPC director. “The ranchers view wild horses as competition for cheap grazing on public lands, and they won’t stop until all the horses are gone.”
“This story is playing out across the West, where ranchers and other corporate interests seek to exploit public lands and upend the Wild Free-Roaming Horses and Burros Act,” said Ginger Kathrens, Executive Director of The Cloud Foundation. “In this case, we draw a line in the sand against the threat posed by ‘welfare ranchers’ and other corporate profiteers to the future of America’s treasured wild horses.”
“We are pleased to be a voice for the future of Wyoming’s mustangs,” said Karen Sussman, President of the ISPMB, the oldest wild horse advocacy group in the nation. “As a party to the original agreement establishing population levels in this area, we will vigorously defend the Wyoming’s wild horses and work toward an agreement that keeps them free where they belong on our public lands.”
RSGA controls the rangeland in the Wyoming checkerboard, an area 40 miles wide by 70 miles long that runs along the historic transcontinental railway corridor.  RSGA owns 550,000 acres outright and leases an additional 450,000 acres from the Anadarko Land Company, a subsidiary of Anadarko Petroleum Corp. RSGA also holds permits to graze livestock on a large portion of the public lands in the checkerboard.  RSGA owns members graze approximately 50,000 to 70,000 sheep and about 5,000 cattle on deeded private lands and leased public lands. By contrast, just 1,100- 1,600 wild horses are allowed to roam the area.
Thanks to taxpayer subsidies, RSGA members graze livestock on public lands for approximately one-twelfth (1/12) of the going market rate. The RSGA complaint, filed on July 27, 2011, seeks a court order that will (a) result in removing all wild horses from private lands in the Wyoming Checkerboard area, and (b) declare that the BLM “must remove all of the wild horses that have strayed onto the RSGA lands and the adjacent public lands within the Wyoming Checkerboard.”
The American Wild Horse Preservation Campaign (AWHPC) is a coalition of more than 50 horse advocacy, public interest, and conservation organizations dedicated to preserving the  American wild horse in viable, free-roaming herds for generations to come, as part of our national heritage.
International Society for the Protection of Mustangs and Burros, founded over 50 years ago, was instrumental in securing the enactment of the 1971 Wild Free-Roaming Horses and Burros Act, the landmark federal legislation that established protections for wild free-roaming horses and burros on public lands in the West.
The Cloud Foundation is a non-profit organization dedicated to the preservation and protection of wild horses and burros on our Western public lands with a focus on protecting Cloud’s herd in the Pryor Mountains of Montana.

The BLM will continue its emergency gather of wild horses in the southern portion of the Jackson Mountains Herd Management Area (HMA) following a court ruling Wednesday.
U.S. District Court Judge Howard McKibben denied a motion to enjoin the use of a helicopter to conduct the emergency gather that is currently underway in the southern portion of the HMA, but enjoined the agency from gathering excess wild horses from the non-emergency areas of the HMA by helicopter before July 1
“The Court recognized that emergency conditions in the southern area of the HMA required prompt action by the BLM,” said Gene Seidlitz, BLM Winnemucca District Manager. “To not take emergency action to gather excess horses to alleviate the distress of the wild horses as they became thinner and weaker by the day was unacceptable.”
“The emergency gather of the southern portion of the Jackson Mountain HMA continues to occur in a safe and humane manner,” said Seidlitz.
The BLM has gathered 368 wild horses since the emergency gather began on June 8.
The BLM estimates it may finish the emergency portion of the gather within the next 5 to 7 days. No helicopter gather operations will be conducted in the non-emergency areas of the HMA before July 1.

Heroic Donkey Keeps Buddies Calm And Safe In CO Wildfire

A take-charge donkey named Ellie is credited with saving three horses and another donkey from the wildfire burning in Fort Collins, CO after the couple boarding them was forced to evacuate.
When the flames from the latest Colorado wildfire burned into the town of Paradise Park on Saturday afternoon, the residents were told to immediately evacuate. This included Mike and Sharon Guli who run an equine boarding facility.
Before leaving, the couple put 5-year-old Ellie, four draft horses and another donkey into an open pasture.
They called Ellie’s owners, Greg and Michele Van Hare, to see if they get to the boarding facility with a trailer for the animals; but by the time they made it to the town access to the area had been closed.
Greg Van Hare told his wife and children “we’re going to trust in God” and tried to prepare them for the loss of the animals.
On Tuesday, the family got a surprise call from Mike and Sharon. Sheriff’s deputies and volunteers found five of the six animals grouped together in the same pasture where they had been left. They told the family that when help arrived, “Ellie walked right up to one of the rescuers and put her head against his chest.”
The rescuers were convinced that Ellie, a “very smart donkey” who often leads the other animals and takes charge of situations with them, had kept her buddies calm and close during the three day ordeal.
“Ellie doesn’t put up with crud,” said Van Hare while he was describing an incident Ellie had with a couple of stallions. “She put her ears back and started walking toward them. She got about 10 feet away, and the stallions turned and left.”
The last horse was also found alive, but it had wandered into a nearby pasture.
All of the animals were transported to the Larimer County Fairgrounds where they were examined by veterinarians from Colorado State University. More than 150 horses, 150 alpacas and llamas, donkeys, sheep, goats and calves have been brought to the fairgrounds this week, after being displaced by the High Park fire.
Overall the horses and donkeys in Ellie’s care, weathered the fire without any serious injuries. Ellie’s nose and coat were singed by the flames, but didn’t need any treatment. The tails of the four horses had curled from the extreme heat.
Veterinarian Brian Miller explained Ellie’s heroic actions to keep her friends safe as pure instinct. Mike Guli said it was more than that.
“Over the years, I’ve seen her do such amazing things. She pretty much takes care of the other donkey and horses. She’s in charge,” said Guli.
Ellie and her companions are now safe on the Van Hare ranch.

Court action taken over prospect of Colorado roundup

Wild horse advoacy groups have filed court action seeking to head off what they fear could be an emergency wild horse roundup in northwest Colorado.
The groups fear the Bureau of Land Management is moving toward an emergency roundup targeting the West Douglas wild horse herd.
Those seeking the emergency motion for a stay against what it calls a “threatened emergency gather” are the Colorado Wild Horse & Burro Coalition, Front Range Equine Rescue, Habitat for Horses, the Cloud Foundation, and Don and Toni Moore.
Their action is against the director of the Department of the Interior, Ken Salazar, and the Bureau of Land Management.
The plaintiffs allege the bureau may be generating an artificial emergency to bypass on-going litigation to prevent the agency from removing the herd.
The plaintiffs, supported by the Wild Horse Freedom Federation, have spent years locked in a legal battle to prevent the bureau “from furthering their long-standing goal of removing the entire North West Colorado wild horse herd from their native public land”.
The organizations collectively allege that they have credible evidence to dispute the bureau’s assertion that a drought emergency exists in the area and the horses must be removed for their own safety.
Last week, the bureau issued two separate warnings to the court that the horses were in distress, but the groups are challenging such claims following what they described as an intensive on-site investigation and survey of the area in question.
In his declaration to the court, local resident and plaintiff Dr Don Moore states: “… in areas where the horses are found there is plenty of fresh water flowing. Some of it flows underground but comes up aboveground in ‘seeps’, which are areas where water bubbles up from freshwater springs beneath the ground and which wild horses regularly find, access, and drink from. We saw many seeps in the past week with a length and a depth sufficient to support the horses. There is, based on my knowledge and experience of this area and these horses, ample fresh water even though an untrained eye might not appreciate the available water in the area.
He continues: “I observed fresh feces from the wild horses and determined that the horses were not dehydrated, based on the size and consistency of the samples observed. Visually, the horses exhibited no signs of dehydration, which could include thin body condition or emaciation.”
Lauryn Wachs, of the Cloud Foundation, also traveled to the area where the bureau said there was no water for the horses and said: “In the past week in the West Douglas Herd Area I observed horses accessing natural water from ‘seeps’, where fresh water was flowing. It was also clear there was ample water for the horses as I observed four horses who were wet, obviously from rolling in mud, a sure sign of available water.”
Wild Horse Freedom Federation volunteer president R.T. Fitch, one of the funding organizations for the court action, added: “This is an old Mustanger trick used by the BLM to circumvent the courts and accomplish what they have always wanted to do, wipe out this entire herd.
“Once again it appears that the BLM is using backroom tactics in an effort to serve their special cattle grazing interests who have joined them in this fight. Private cattle stay, public wild horses go; it’s nothing short of insanity.”
The battle over the West Douglas herd is nearly two decades old.

The battle over the West Douglas herd is nearly two decades old, and only through the efforts of concerned citizens and organizations have the horses been saved from the BLM’s desire to remove them all from their homelands.  In 2009, concerned citizens and organizations won the first case in the United States against BLM’s practices of eliminating wild horse herds when Judge Collyer set aside BLM’s 2008 roundup plans.  In 2010 advocates again sued the BLM and the BLM withdrew its plans to decimate the herd. Likewise, in 2011 the BLM was held at bay by the advocacy groups.

Horses found dead following BLM roundup

RENO, Nev. (KRNV & MyNews4.com) -- Six wild horses have been euthanized and three were found dead this morning following the Bureau of Land Management's roundup currently underway in Northern Nevada.
The roundup started June 8, and three weeks in, they have gathered more than 400 horses.
BLM Spokesperson Jolynn Worley says they could be done in this area as early as tomorrow.
According to the BLM website, there have been six horse deaths since the beginning of this roundup, but they are listed under "non-gather-related." Worley says those horses were euthanized.
"These are animals that have chronic preexisting conditions not related to the gather," Worley says.
Shortly after News 4 spoke with Worley, she said three horses had been found dead at the Palomino Valley Complex this morning. One mare had died from a broken neck, and two foals had died from "poor body conditions."
The horses were brought to Palomino Valley from the roundup and will be considered "non-gather related" because they were found at the complex, not onsite.

The roundup has been controversial from the start because it's taking place during foaling season, when mares are pregnant and new colts are born. The season goes through July 1, but BLM says drought has caused an emergency situation in the southern portion of the Jackson Mountains herd management area.
BLM says they are maintaining the roundup to be as safe as possible.
Once BLM finishes the roundup in the southern portion of the Jackson Mountains area, they will move to the northern portion. A judge recently ruled they cannot begin that roundup until July 1 (after foaling season) because it's not an emergency area.

Nevada Jurist Issue Preliminary Injunction Against Dangerous Helicopter Practices

HOUSTON, (Horseback) – A Nevada federal judge has issued the strongest ruling yet against the Bureau of Land Management and it’s controversial Wild Horse and Burro Program in the wake of a powerful rebuke of the agency’s secretive practices by a California appeals court in the case of Leigh vs. Salizar. The case could be what is termed a landmark case for freedom of access for press and public om federal venues such as wild horse “gathers”  if upheld by the U.S. Supreme Court.
Reno Federal Judge Howard J. McKibben issued a preliminary injunction Friday to halt pilot conduct in the Triple B Complex case that was amended following the decision in the Ninth Circuit. The plaintiff in each case was Laura Leigh, a freelance writer and photographer credentialed by Horseback Magazine and Horseback Online. She  is represented by Reno attorney Gordon Cowan. The ruling could be converted to a permanent injunction against the BLM practice of using helicopters to stampede horses over miles of rough desert land.
McKibben  wrote that the court, “enjoins and restrains the defendants and their agents from flying helicopters dangerously or unreasonably close to the wild horses during any roundup at the Triple B complex pursuant to defendants’ May 17, 2011 final environmental assessment and decision for the complex.
The ruling is a potentially devastating blow against the use of helicopters in the roundup of wild horses in the West. The preliminary injunction in the Nevada court opens the door to injunctions in other jurisdictions. The BLM is almost certain to appeal.
Leigh issued a press release late Friday giving details of the case.
In August of 2011 Plaintiff Laura Leigh, founder of Wild Horse Education, gained a Temporary Restraining Order (TRO) that shut down the Bureau of Land Management’ (BLM) Triple B roundup in Eastern Nevada. The TRO was granted directly related to the pilot flying “dangerously or unreasonably close” to wild horses during roundup operations. Specifically Leigh’s camera caught a pilot apparently striking and exhausted animal. During the hearing the Judge referenced the agencies attempt at justification a:  “blame the horse affront.”

Following a victory in the Ninth Circuit on Freedom of the Press issues involving wild horses, Leigh’s attorney, Gordon Cowan of Reno, amended the Complaint to address the new case law.

“With each new case that wins you create a new vocabulary of sorts within the conversation of law,” says Cowan, “If you spend time in a law library reading cases you can see the evolution of the conscience of our nation. “

“Rulings like these help to validate the marathon of documentation and creating a chain of information,” said Leigh, “This has been a grueling process lasting years. It is extremely encouraging to see that the ‘faces of the voiceless’ are being heard.”

PHOENIX - A therapeutic riding center dedicated to helping disabled children is out thousands of dollars after a burglary.

Thieves broke into a back door window at the Horses Help Therapeutic Riding Center near Cave Creek Road and Rose Garden Lane in North Phoenix.

"This is ridiculous," said Greg Goodman, the executive director of the center. "It is senseless."

The thieves kicked down an office door and stole cash and several items, like a signed guitar from Alice Cooper, that were to be part of an upcoming fundraiser auction.

In all Goodman says they are likely going to be out $2,500.

"That is a scholarship for a kid who can't afford the program," he said.

The center works with kids with both mental and physical challenges. The horse therapy is something that Goodman said is unique and has been life-changing for many of the families participating.

"I have parents come to me in tears because their kid hugged them for the first time or said 'I love you,'" he said.

Goodman said there are no suspects and likely no witnesses because the thieves entered from the back where it was harder to be seen.

The BLM will continue its emergency gather of wild horses in the southern portion of the Jackson Mountains Herd Management Area (HMA) following a court ruling Wednesday.
U.S. District Court Judge Howard McKibben denied a motion to enjoin the use of a helicopter to conduct the emergency gather that is currently underway in the southern portion of the HMA, but enjoined the agency from gathering excess wild horses from the non-emergency areas of the HMA by helicopter before July 1
“The Court recognized that emergency conditions in the southern area of the HMA required prompt action by the BLM,” said Gene Seidlitz, BLM Winnemucca District Manager. “To not take emergency action to gather excess horses to alleviate the distress of the wild horses as they became thinner and weaker by the day was unacceptable.”
“The emergency gather of the southern portion of the Jackson Mountain HMA continues to occur in a safe and humane manner,” said Seidlitz.
The BLM has gathered 368 wild horses since the emergency gather began on June 8.
The BLM estimates it may finish the emergency portion of the gather within the next 5 to 7 days. No helicopter gather operations will be conducted in the non-emergency areas of the HMA before July 1.

Jackson Mountains Wild Horse Gather

The Jackson Mountains Herd Management Area is located approximately 60 miles west of Winnemucca, Nevada. The area is bordered on the west by the Black Rock Desert, on the east by Desert Valley.
Continuing drought conditions, coupled with excess wild horse populations in and around the Jackson Mountains HMA, are resulting in increasing risk to the wild horse population and range health.
The situation is escalating and the BLM has determined that 630 wild horses need to be removed in order to be in compliance with the Wild Free Roaming Horses and Burros Act of 1971.
A population survey conducted in early April revealed 740 adult wild horses in the Jackson Mountains HMA gather area; with the expected 2012 foal crop this equates to approximately 930 horses.
The initial Proposed Action released to the public in the preliminary EA was to conduct an initial gather in the summer of 2012.  The action also contained a gelding component.  
Due to escalating conditions leading to an emergency situation since the release of the preliminary EA, the Proposed Action has been modified to conduct an emergency gather in early June, with an option to delay the initial gather to the original start date.  The proposed action was also modified by removing the gelding component.
After the initial gather, whether in June or on or after July 1, the Modified Proposed Action would implement a long term management strategy designed to address large scale wild horse gathers while still achieving BLM’s management goals of attaining AML, reducing population growth rates, and obtaining a thriving natural ecological balance on the range as identified within the WFRHBA and the Director’s Strategy.
Under the Modified Proposed Action, the BLM would gather and remove approximately 75% of the existing wild horses (approximately 630 excess animals) in the initial 2012 gather.  Since the first phase of the Modified Proposed Action would only allow for the removal of approximately 630 excess wild horses and would not achieve the desired low AML, two to three follow-up gathers over a period of ten years is proposed.

Judge restricts helicopter use in Jackson roundup

 




















A judge in Nevada has granted part of a temporary restraining order sought against the Bureau of Land Management over its emergency wild horse muster in the Jackson Mountain herd area.

The bureau roundup began under urgency on June 8 because of concerns over drought and a lack of forage in the southern part of the animals’ range.
However, the decision to move the planned muster of 630 horses a month forward because of the drought placed it in the foaling season.
Wild horse advocates criticised the roundup, pointing to the dangers inherent in running newborn foals and heavily pregnant mares, who could slip their foals because of the stress.
The bureau countered that the muster was necessary, given the circumstances on the range, and undertook to take care.
On Wednesday, in Federal District Court in Reno, Judge Howard McKibben granted part of a temporary restraining order sought against the bureau by wild horse advocate Laura Leigh.
The ruling allows the bureau to use helicopters only in the southern part of the range where drought issues were causing welfare concerns, and not in other parts of the range, where the situation was less serious, during the foaling season.
Leigh argued that the bureau launched the roundup because of a water emergency in the southwest portion of the area, but used it to begin a removal operation in the entire area of wild horses during foaling season. The bureau’s own protocols prohibit roundups during foaling season except in emergency situations.

“The ruling reflects that Judge McKibben understands that the agency justified an action and then broadened their discretion to take actions that they had not justified,” said Gordon Cowan, the Reno-based attorney for Leigh, after the hearing.
“There is a clear distinction under law and the court’s ruling was a clear reflection of that distinction.”
Leigh, the founder of Wild Horse Education, has been monitoring the roundup. She said: “I understand the positive importance of the ruling and recognition of distinct language in the system to begin to attain any accountability within the agency, but I am still gravely concerned.
“This agency is well known for pushing boundaries and the very real potential exists that they will continue to push at Jackson until they create another imbalance that can lead to further inappropriate action.”
Leigh is referring to the fact that the agency is limited to using helicopters to roundup wild horses to the scope of the documented emergency in the south of Jackson.
“The agency has targeted 630 animals for removal,” Leigh said.
“If they push in the south they will imbalance an area. The right thing to do would be to stop for now, as more than 315 horses have been removed from the south, and monitor to see if enough pressure has been removed from the range. But is that what we can expect?”
She said there were currently are no formal use restrictions anywhere within the Jackson Mountain herd area for any users.
The area had livestock grazing and considerable extractive industry, she said.
“If the concept here, according to the law is fair and equitable use,” Leigh said, “how can there be an emergency of such magnitude that it requires running newborn foals in the desert heat during the most fragile time of their lives, if no other use has a restriction?”

RENO, (Wild Horse Education) – On June 20,2012 in Federal District Court in Reno, Hon. Judge Howard J. McKibben granted part of a Temporary Restraining Order (TRO) sought against the Bureau of Land Management (BLM).
A roundup began June 8, 2012 under the management of BLM’s Winnemucca District manager Gene Seidlitz. Within the supporting documents justification process BLM cited a water emergency in the south west portion of the area and utilized that to begin a removal operation in the entire area of wild horses during foaling season as defined by the agency. The agency prohibits this activity during foaling season within BLM’s own protocol in all but emergent situations.

When horses are purchased at auction by buyers intending to kill them, they're hauled away in double- decker tractor trailers where they are beaten and often blinded with baseball bats to mollify them. After crossing the border into Mexico, the animals are stabbed on each side-an act to tenderize their meat-and immobilized. Workers, then saw the horses legs off, at the knee and hang them to bleed out-all while the horses are ALIVE! In 2010 Florida Legislation unanimously passed the Horse Protection Bill, making it a felony to slaughter horses for personal or commercial use.)
